wage garnishment on an old debt?
9 years ago I financed a truck. Like most people my age I was young and dumb and got in over my head. Around 5 years went by and I was contacted by a collection agency. They told me I had to make payments or they would take my home and garnish my wages. So I began making payments. In december my automatic payment bounced. The collection agency called me yesterday and told me If I don't pay them $16,000.00 by Monday they are going to garnish my wages. I have a few questions on this.1. The statute of limitations in Oklahoma (where I live) is 5 years so wouldn't the debt be invalid or does the fact that I made payments disolve the statute.2. I was never told originally that I had a right to dispute the debt. So can I dispute it now. A buddy told me that payment installments would be considered as admission unless I could prove The verbal debt was invalid due to unfair collection practices. Unfortunately (or fortunatelly depending on how you look at it.) I don't have much experience with debt collectors and I have no proof of anything. It may also be pertinent to mention that the verbal agreement was over 3 years ago (statute of limitations on a verbal agreement is 3 years in oklahoma) however the last payment was only 2 months ago. ------
