I am applying for a retail managment position and they sent my information to GIS services. I filed bankruptcy 12/1998. By law is GIS allowed to"fail"me in the background check? Is there a cut-off in years they go back? ------

Bankruptcy stays on your credit report for 10 years.I doubt there are any laws concerning how far back GIS can go to do a background check. Even if the bankruptcy were more than 10 years old, it might be an automatic fail as indicating a lack of financial management ability. ------

a bankruptcy can stay on your credit for 10 years; however, GIS can"fail"you for any reason they deem necessary. a background check usually goes back to your first job and first line of credit. a healthy background check = no drug use, good working history and a good financial history - so yes, GIS had every right to fail you. sorry. ------
